http://chic.clipsyndicate.com/video/playlist/12492/7207361?cpt=8&wpid=2637 Mon, 11 Dec 2017 04:36:23 +0000 Lawline: Filing a Personal Injury Claim On Your Own When it comes to filing a claim, anyone can represent themselves in court. http://chic.clipsyndicate.com/video/playlist/12492/7207361?cpt=8&wpid=2637 WAAY ABC Huntsville, AL them out. you can send any legal question to lawline@waaytv.com. >> tommy siniard: i understand you were there for the snow. >> sharon doviet: i got to see it and it was beautiful up there. >> tommy siniard: was it awesome. >> sharon doviet: perfect. and huntsville got nothing, right? i was in birmingham for cle and it got snowed out. >> tommy siniard: we missed it, but i'm glad you made it home safe. >> sharon doviet: but it all melted too quickly. can an individual file a personal injury claim themselves? do you have to be a lawyer or have a lawyer to file a claim if you get hurt in a personal injury kind of thing, a car accident, medical malpractice case? >> tommy siniard: in any case, you can represent yourself in a capital murder case. any citizen can represent themselves in court. and i tell people -- people can operate on themselves too, they can take out their tonsils, get a mirror and sharp enough knife and a lot of courage. i don't recommend that either. but, yes, you can. in fact, in small claims court, it's like the people's court, claims less than $3,000, you can represent yourself, and it works out pretty good. but i would recommend somebody getting a lawyer for an injury case. you know, it's more complicated than anybody wants to realize. if you've got a serious injury or it's a medical malpractice or products liability, those things are so difficult, when an insurance company is against you, which generally that's what we're up against day in and day out because none of them do what they say they'll do. it makes sense to get a lawyer. lawyers consult on personal injury cases, not just our firm but others, for free, to give you -- tell you your rights and what you're entitled to or. what you may be entitled to and most of them charge a percentage of what is record so you don't have to fork out a bunch of money to hire a personal injury attorney. they only get paid if they win. and that's how our firm operates. >> sharon doviet: and judges are going to hold people to the same standard, if you represent yourself, judges hold you to the same standard as though you are a lawyer, so be prepared. >> tommy siniard: that's true,
